These Terms describe and govern the terms and conditions applicable to your use of or access to the Websites and the products and services provided or offered through or in connection with the Company or the Websites (collectively, “Service”).  These Terms, the Websites, and the Service may be modified, updated, or changed at our discretion at any time for any reason or no reason without notice to you. We may also use or rely upon different, other, or additional terms and conditions. 

Use of the Websites and Service is limited to and intended for individuals located in the United States and to persons eighteen (18) years of age or older. By using this Website, you represent and warrant that you are eighteen (18) years of age or older and meet all of the foregoing eligibility requirements. We recommend that you review the terms, conditions, and policies posted on third-party websites prior to using or accessing those websites.  

All of the content on our Websites, including, but not limited to, information,  materials, text, displays, images, video, and audio, and the design, selection, and arrangement thereof and other items available through our Websites, are the sole and exclusive property of the Company, its licensors, related companies, or affiliates, and are protected by copyright, trademark, and other intellectual property laws. Except for the limited licenses expressly granted to you in these Terms, the Company or its licensors, related companies, and affiliates expressly reserve all other rights and licenses.

These Terms of Use permit you to use the Websites for your personal use only. You must not reproduce, distribute, modify, create derivate works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Websites, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.

  • Modify copies of any materials from the Websites.

You must not access or use for any commercial purposes any part of the Website or any services or materials available through the Websites.

You are solely responsible for any information that you submit, provide, transmit, or post on our Websites, if the option is available to you. By using or accessing our Websites you agree not to submit, provide, post, or transmit any defamatory, abusive, obscene, threatening, or illegal content, information, or material, or any other items that infringe or inhibit on the ability of others to enjoy our Websites or that violate the rights of others. We reserve the right to deny access to anyone who we believe, in our sole discretion, has violated these Terms.

We reserve the right (but assume no obligation) to monitor, delete, move, or edit any submissions or postings that come to our attention that we consider unacceptable or inappropriate, whether for legal or other reasons. We will comply with all requirements of the law regarding disclosure of any submissions or postings on our Websites to others, including, but not limited to, to law enforcement agencies and parties making civil legal requests. We will also comply with any other requirements of the law regarding disclosure of other aspects of your use of our Websites.

Third-Party Processing

If so indicated, Company may elect to use the services of a third-party provider of payment processing (the “Third-Party Payment Processor”) instead of the Company’s payment processing services. In such a case, the Company may make available to you a means of interconnection for transmitting payment-related data through the Company’s payment gateway to the Third-Party Payment Processor for the purpose of processing payments. You shall comply (and as between the parties hereto shall bear sole responsibility for complying) with all terms and conditions of use of the Third-Party Payment Processor’s services.

Termination 

The Company reserves the right at any time to terminate your use of our Websites, or any portion thereof, if you fail to comply in full with any portion or the Terms, or any other terms, agreements, or policies that apply to our Websites, the Service, the Company, or our products.

Indemnification

You agree to indemnify, defend, and hold harmless the Company (including, but not limited to, its parents, subsidiaries, related companies, and affiliates and all of their respective officers, directors, employees, agents, licensors, suppliers, and any third-party information providers) from and against any and all claims, losses, expenses, damages, and costs (including, but not limited to, reasonable attorney fees) resulting from (i) any breach of these Terms or use of our Websites; and (ii) your access to or use of any services or products of any Third-Party Payment Processor (including without limitation breach of any contractual or other obligations owed to any Third-Party Payment Processor). Your indemnification obligation shall survive the termination of the Terms. At our expense and election, we reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you and you agree to cooperate with Company in connection with our defense.

Exclusions and Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. To the extent a court determines any provisions in this Agreement to be unenforceable; such a determination shall not affect the validity of the remaining terms of this Agreement, which shall remain in full force and effect.

Applicable Law and Venue

By visiting and/or using the Websites, you agree that the laws of the State of Delaware, without regard to principles of conflict of laws, will govern these Terms and any dispute of any sort that might arise between you and the Company, including, but not limited to, its subsidiaries, related companies, affiliates, agents, or licensors, related to these Terms or use of the Websites.  You agree that any claim or legal proceeding arising out of or relating to the Websites or these Terms must be brought only in the federal and state courts of Delaware.

Changes to the Terms

We may periodically change or modify the Terms without notice, and you are responsible for checking these Terms periodically for revisions. All amended Terms of Use become effective upon our posting to the Websites, and any use of or access to the Websites after such revisions have been posted signifies your consent and agreements to the changes and modifications.

Restrictions

You must confirm and ensure compliance with all local, state, and federal laws, regulations, rules, policies, and guidance, including, but not limited to, concerning the lawful ownership or use of firearm magazines prior to ordering.  You acknowledge that the local, state, and federal laws, regulations, rules, policies, and guidance vary from state to state. It is your responsibility to ensure that you are in compliance with your state’s laws, regulations, rules, policies, and guidance. You acknowledge and agree that you will comply with all applicable local, state, and federal laws, regulations, rules, policies, and guidance concerning the lawful ownership and use of firearm magazines. Please note that, as of the date of these Terms, we do not sell or ship magazines that are capable of holding more than ten (10) rounds.  We reserve the right to restrict shipments at any time, to any customer, in any jurisdiction, or to impose additional requirements.

You shall only access, visit, or use the Websites for lawful purposes and agree to comply with all local, state, and federal laws, regulations, rules, policies, and guidance applicable to you or the Company. 

You shall not: 

  • Violate any local, state, and federal laws, regulations, rules, policies, and guidance;
  • Violate the rights of any other individual or entity, or which does, or tends to, exploit, injure, or otherwise harm any other individual or entity, including, but not limited to, minors;
  • Impact, impair, disrupt, interfere with, or effect the performance, use, enjoyment features, or functionality of the Websites; and
  • Provide, submit, or post content, information, or materials that are false, misleading, illegal, or fraudulent, including, but not limited to, with respect to your identity.
